2026 Premium Membership

These terms and conditions govern participation in the Gilroy Gardens 2026 Premium Membership and are in addition to our Terms of Use. By purchasing, activating, or using a Membership, you agree to be bound by these terms.

2026 Premium Memberships include unlimited admission for the 2026 regular year as well as separately ticketed Signature Events for 2026 including: Voyage to the Islands, Carnival Nights, The Great Big BOO, and North Pole Nights.

Premium Membership is valid only at Gilroy Gardens and grants a revocable license to the registered holder for admission and use of all open rides (unless restricted by conditions which could ultimately prohibit someone from riding safely, including but not limited to height, weight, age, physical limitations such as pregnancy and heart conditions, or observed appropriate behavior), shows and attractions on any regularly-scheduled operating day through December 31, 2026. A Premium Membership is valid for only one visit per day, a hand stamp is required for same day re-entry. This membership also does not include admission to park areas not open to the general public or requiring a separate admission fee. Fees for food, merchandise, games, pay-per-experience attractions and concerts and are not included.

To gain entry to the park, a valid Premium Membership, with a photo of the Member associated with the Membership, must be displayed and validated at the park entry. Members who did not associate a photo with their Membership at the time of purchase will be required to have a photo taken and added by Gilroy Gardens during their first entry. Any attempt to gain admission using Premium Memberships by a guest to whom the membership was not originally issued will result in immediate revocation and all benefits of the membership terminated without refund. Each visit is subject to applicable park rules and restrictions. Guests not meeting the Premium Membership qualifications for park entry will be required to upgrade.

A Premium Membership is not valid for private events, park buyouts, park closing due to full capacity or special events (such as Camp Nights) at which an additional admission fee is charged. All operating dates and hours are subject to change without notice. All rides and attractions are subject to closings and cancellations for weather or other conditions.

Premium Memberships are non-transferable, non-refundable, non-exchangeable and not valid for cash. A Premium Membership may also be revoked, all member benefits terminated without refund, and the member removed from the park for any misuse, failure to abide by applicable terms and conditions, or conduct detrimental to the park, including but not limited to theft of property or services; violation of Federal, State, or Local laws; safety procedures; vandalism; disorderly conduct; intoxication; or possession of intoxicating liquors (except as properly purchased within the park with valid identification and used in a responsible manner), drugs, or weapons.

A Premium Membership is always required for admission. If Premium Membership is lost, stolen, or forgotten, Gilroy Gardens may be able to reissue a Membership for a non-refundable replacement/lookup fee, or a regular park admission ticket may be purchased at full gate price. Premium Membership may not be used in connection with any other promotional offer or ticket (except specifically designated for the Premium Membership). Unauthorized resale is prohibited.

2026 Value Memberships include unlimited admission to regular public operating days ONLY between March 28, 2026 – August 9, 2026 (excluding Carnival Nights, The Great Big BOO, North Pole Nights, and New Year’s Eve).

Value Membership is valid for only one visit per day; a hand stamp is required for same-day re-entry. This pass also does not include admission to park areas not open to the general public or requiring a separate admission fee. Fees for parking, food, merchandise, games, pay-per-experience attractions, concerts and special events are not included.

Official Social Media & Email Giveaway Rules

By participating in the current Social Media or Email sweepstakes promotion sponsored by Gilroy Gardens Family Theme Park (collectively the “Gilroy Gardens Accounts” on platforms such as TikTok, Facebook, Instagram, or other social media channels and emails), you agree to these Official Social Media and Email Giveaway Rules, which constitute a binding contract. Please read them carefully before participating. This contract includes indemnities for the Released Parties and limitations on your rights and remedies. Participants will be referred to as “you” or “Participant.”

Eligibility & Entry Requirements

The details and requirements for entering or participating in any Promotion will be provided by the Gilroy Gardens Accounts at their discretion. Participants must adhere to all directions provided by the Gilroy Gardens Accounts and comply with these Official Social Media Giveaway Rules to be eligible for any prize.

Participants must be at least 18 years old (or the legal age of majority in their state or jurisdiction) to participate. To enter, you must either be a follower of the Gilroy Gardens social media accounts announcing the Promotion or, if the sweepstakes is conducted via email, be subscribed to our email newsletter. Employees, officers, directors, representatives, and agents of any Released Parties (defined below), including their immediate families and those residing in their same household, are ineligible to participate.

Giveaway recipients will be determined solely at the discretion of Gilroy Gardens Family Theme Park. If you have won a Promotion within the last 30 days, you are not eligible to win again. If a selected winner is deemed ineligible, Gilroy Gardens Family Theme Park may, at its discretion, either withhold the prize or select another eligible winner. To receive a prize, you may be required to provide your full name, address, age, and other necessary details via a private and secure communication method. Your information will only be used for prize fulfillment purposes and will not be retained or used for other purposes, except as outlined in the Winner Information section below.

Intellectual Property & Submission Rights

By participating in the Promotion, you acknowledge that any materials submitted, including but not limited to photographs or comments, are considered “works made for hire” under the U.S. Copyright Act. As such, Gilroy Gardens Family Theme Park holds all rights, including copyright, to these materials. If any material does not qualify as a “work made for hire,” you hereby irrevocably assign all rights to Gilroy Gardens Family Theme Park, including the right to use, modify, and distribute the materials in any manner, media, or format now known or hereafter developed, worldwide, and in perpetuity.

Conduct & Liability Release

Participants must not engage in reckless, harmful, or negligent behavior while pursuing or accepting a prize. Any Participant acting in an unsportsmanlike or disruptive manner will be disqualified. You are solely responsible for any injuries or damages resulting from your participation. By entering, you agree to indemnify, release, and hold harmless the Released Parties from any and all claims, liabilities, losses, or damages related to the Promotion.

Taxes & Prize Conditions

Each winner is responsible for all applicable federal, state, and local taxes associated with the prize. If required by law, the fair market value of the prize may be reported to tax authorities. Gilroy Gardens Family Theme Park is not responsible for any tax obligations incurred by the winners.

Publicity & Winner Information

By accepting a prize, you grant Gilroy Gardens Family Theme Park the right to use your name, city/state of residence, photograph, voice, statements, and other likeness for advertising, promotional, and trade purposes worldwide, in any format, and in perpetuity without additional compensation, unless prohibited by law.

Legal Compliance & Dispute Resolution

This Promotion is subject to all applicable federal, state, and local laws and regulations. In the event of a dispute, the Promotion will be governed by the laws of the State of Gilroy Gardens Family Theme Park, without regard to conflict of law principles. Any disputes must be resolved individually and not through class actions. Under no circumstances will Participants be entitled to recover punitive, incidental, or consequential damages, and any claims are limited to actual out-of-pocket expenses not exceeding fifty dollars ($50.00). Some jurisdictions do not allow such limitations, so they may not apply to you.

Modification & Termination

Gilroy Gardens Family Theme Park reserves the right to modify these Official Social Media Giveaway Rules at any time for clarification purposes without materially altering the terms. If a legal or regulatory authority challenges the Promotion, Gilroy Gardens Family Theme Park may suspend or terminate it at its discretion. In such cases, the Released Parties shall have no liability to affected Participants.
